1. Scope
These terms govern your use of the iOS application HelloWorkout (the "App"), provided by Daichi Asatsuma (朝妻大智) ("we"). By using the App you agree to these terms.
How information is handled is described in the Privacy Policy.
2. Price
The App is provided free of charge.
3. Your records are yours
The records you enter in the App belong to you. We do not hold them and claim no rights over them.
4. Restrictions
- Do not copy, modify, or redistribute the App.
- Do not use the App, or any part of it, for any unlawful purpose.
- Do not interfere with the operation of the App.
5. Health and safety disclaimer
This section is the heart of these terms. Please read it.
The App is not a medical device, and nothing in it is medical advice. The App stores the records you enter and summarizes and displays them; that is all it does.
The numbers the App shows are estimates for reference only. Estimated one-rep max, training volume, and correlations between condition and performance are calculations derived from the values you entered. We do not warrant their accuracy or suitability, and they are not a recommendation of any particular weight, repetition count, or training frequency.
What you train, and whether to train at all, is your own decision and responsibility. We are not liable for injury, illness, changes in physical condition, or any other physical or mental harm arising in connection with your use of the App.
If you have a medical condition, are pregnant, are undergoing treatment, or have any concern about your health, consult a physician before beginning to train.
6. Storage and backup
Your records are stored only on your device. We keep no copy on any server.
Records may be lost through device failure, loss, or reset, through deleting the App, or through defects arising from OS or app updates. Preserving your records is your responsibility.
We cannot recover lost records.
The App can export all of your records into a single file and restore them from it. We recommend exporting regularly, so that you are covered if you change or reset your device. The exported file is not encrypted (it includes body weight, sleep and notes). Please be careful where you store and send it.
Restoring replaces, it never merges. When you restore from a file, every record currently in the App is replaced by the contents of that file. Existing records are not combined with the file's contents, and the operation cannot be undone. Immediately before restoring, the previous state is set aside on your device (this is a safeguard against faults, not something you can retrieve yourself).
7. No warranty
The App is provided as is. We do not warrant that it will meet your particular requirements, operate without interruption, or be free of defects.
8. Limitation of liability
We are not liable for any damages arising in connection with your use of the App, except in cases of our willful misconduct or gross negligence.
Where you are a consumer under applicable consumer protection law, this section and the preceding section apply only to the extent permitted by that law.
9. Changes to the App
We may change the App or discontinue it. If we discontinue it, we will give notice in advance where practicable.
10. Changes to these terms
We may revise these terms. Revised terms take effect when posted on this page.
11. Relationship with Apple
The App is not provided or warranted by Apple Inc. ("Apple"). These terms are an agreement between you and us; Apple is not a party to them. We are responsible for responding to inquiries and claims concerning the App.
12. Governing law and jurisdiction
These terms are governed by the laws of Japan. Any dispute concerning the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
Where you are a consumer under applicable consumer protection law, this section applies only to the extent permitted by that law (as in Section 8).
